Article 1 (Purpose)
These Terms govern the relationship between the Company and Hosts listing accommodations on the platform.
Article 2 (Platform Status)
The Company operates as a marketplace intermediary. Accommodation contracts are formed directly between Host and Guest.
Article 3 (Host Representations)
The Host guarantees:
- The property exists and is legally rentable.
- The Host has authority to operate it.
- The listing does not violate lease terms, HOA rules, or law.
- Descriptions and photos are not materially misleading.
- The property is check-in ready on the agreed date.
Article 4 (Legal & Tax Compliance)
Hosts are solely responsible for regulatory compliance, licensing, and tax obligations. Government penalties are borne by the Host.
Article 5 (Fraudulent Listing & Guest Protection)
In cases of:
- Fake listing
- Material discrepancy
- Double booking
- Check-in impossibility
- Major safety defects
The Company may take one or more of the following measures, based on objective evidence:
- Refund the full amount of each affected Period (100%) to the Guest, including the initial payment, without applying any penalty or prorated deduction.
- Arrange alternative accommodation and cover reasonable price differences.
- Withhold settlement for the reservation.
- Deduct previously disbursed settlement from future settlements.
- Claim damages and restrict or terminate the Host account.
Amounts already disbursed to the Host as settlement-complete are, in principle, not clawed back; instead, the Guest's right of occupancy is preserved for the corresponding window by adjusting the reservation end date. The Company may seek indemnification from the Host for refunds, compensation, or alternative arrangement costs incurred, and may impose penalties (exposure limits, settlement reductions) for repeated Host-fault incidents.
Article 6 (Standard Refund Policy)
All reservations are subject to the Company's standard refund policy. Refund calculations are Due Date–based.
Article 7 (Settlement Policy & Service Fee)
- Each Period is settled within six (6) calendar days from the applicable settlement reference date. Settlement is processed manually by the Company's administrator.
- First Period: the Guest's check-in date.
- Subsequent Periods: the date 30 days after the payment date for that Period.
- Host Service Fee. The Company may charge a service fee to the Host as consideration for the Service, deducted at the time of settlement. (a) Rate. The rate is determined by the Company within a range of 0% to 10% of the sum of rent and maintenance fee for each Period. The actual rate applied may vary within this range depending on promotions, individual contracts, discount policies, events, host tier, and similar factors. (b) The rate displayed in the Host settlement disclosure at the time of reservation confirmation is the final rate applied to that reservation. Subsequent rate changes do not affect the settlement of already-confirmed reservations. (c) The Host service fee for each Period is calculated as (rent + maintenance fee) × the confirmed rate. The cleaning fee is excluded from the rate calculation base.
- The Company may deduct only:
- The Host Service Fee (paragraph 2)
- Refund amounts (per policy or dispute adjustment)
- Dispute adjustments
- Confirmed damages
- PG fees shall not be deducted.
- Unpaid utilities shall not be deducted.
- Settlement may be withheld reasonably during disputes.
- Previously paid amounts may be adjusted in future settlements if justified.
Article 8 (Account Restriction)
The Company may suspend or terminate accounts for:
- Fraudulent listings
- Repeated disputes
- Legal violations
- Platform trust violations
Membership withdrawal & account recovery (30-day grace period): Hosts may request withdrawal at any time within the Service. Upon the request, the account is suspended immediately and registered listings are unpublished. To support account recovery and prevent misuse (e.g., re-registration by malicious users), member information is retained for 30 days after the withdrawal request and then completely destroyed without delay. Logging in again within 30 days restores the account and its listings. During the grace period the account cannot be used and the same email address cannot be used to sign up again. Reservation requests automatically cancelled at withdrawal are not revived upon recovery. All marketing communications stop immediately upon the withdrawal request. Withdrawal may be restricted while an active contract or pending settlement remains. Statutory record retention follows the Privacy Policy.
Article 9 (Indemnification)
Hosts indemnify the Company against losses arising from Host misconduct or legal violations.
Article 10 (Governing Law)
These Terms are governed by Korean law.
Article 11 (Notices & Amendments)
The Company may notify Hosts by posting on the Service or by email (help@homesinkor.com); Hosts must keep their contact information up to date. When these Terms are amended, the Company announces the effective date and the reasons at least 7 days in advance, and at least 30 days in advance for changes unfavorable to Hosts.
