Homes in Korea
These Terms govern the relationship between the Company and Hosts listing accommodations on the platform.
The Company operates as a marketplace intermediary. Accommodation contracts are formed directly between Host and Guest.
The Host guarantees:
- The property exists and is legally rentable.
- The Host has authority to operate it.
- The listing does not violate lease terms, HOA rules, or law.
- Descriptions and photos are not materially misleading.
- The property is move-in ready on the agreed date.
Hosts are solely responsible for regulatory compliance, licensing, and tax obligations. Government penalties are borne by the Host.
In cases of:
- Fake listing
- Material discrepancy
- Double booking
- Move-in impossibility
- Major safety defects
※ Please note. Items on which judgement can differ from person to person — such as cleanliness, natural light, or odour — vary by individual and may not be accepted as grounds for cancelling a contract.
The Company may take one or more of the following measures, based on objective evidence:
- Refund the full amount of each affected Period (100%) to the Guest, including the initial payment, without applying any penalty or prorated deduction.
- Arrange alternative accommodation and cover reasonable price differences.
- Withhold settlement for the reservation.
- Deduct previously disbursed settlement from future settlements.
- Claim damages and restrict or terminate the Host account.
Amounts already disbursed to the Host as settlement-complete are, in principle, not clawed back; instead, the Guest's right of occupancy is preserved for the corresponding window by adjusting the reservation end date. The Company may seek indemnification from the Host for refunds, compensation, or alternative arrangement costs incurred, and may impose penalties (exposure limits, settlement reductions) for repeated Host-fault incidents.
All reservations are subject to the Company's standard refund policy. Refund calculations are Due Date–based.
This Article sets out how the standard refund policy under Article 6 is actually calculated, and is identical to Article 10 (Refund & Early Termination) of the Guest Terms of Service. Because refund amounts directly affect Host settlement, they are stated here so that the Host can review them in advance. The provisions below apply in the order listed; a higher-ranked provision, if its requirements are met, prevails over the calculation methods in lower-ranked provisions.
1) 24-Hour Free Cancellation (Full Refund)
The Guest may cancel the reservation with a full refund of the initial payment if both of the following conditions are met:
- Cancellation is made within 24 hours of the payment timestamp (minute-precise, KST); and
- Cancellation is made no later than 24 hours before 15:00 KST on the move-in date.
- If either condition fails, free cancellation does not apply and §2 or §3 below governs.
- Reservations paid on the move-in day cannot satisfy Condition 2 and are ineligible for free cancellation.
- Upon a successful free cancellation, subsequent Periods are voided (no auto-billing) and the reservation is excluded from Host settlement.
2) Before Check-In — Days-Remaining Tier (Item-Separated)
Refunds are calculated by item based on the number of days remaining until move-in:
| Days remaining | Rent · Maintenance fee · Service fee | Cleaning fee |
|---|---|---|
| 31 or more (more than 30 days before move-in) | 100% refund | 100% refund |
| 16 to 30 (30 to 16 days before move-in) | 50% refund | 100% refund |
| 15 or fewer (from 15 days before move-in) | No refund | No refund |
The date exactly 30 days before move-in is counted as "30 days remaining" and falls in the 50% tier.
3) After Check-In — 30-Day Penalty Model (Departure Date Based)
- Penalty: Equal to 30 days of usage fees calculated from the Guest's designated departure date (per-day equivalent of rent, maintenance fee, and service fee × 30 days). The penalty is 30 days even when the next billing Period is a partial (less than 30 days) prorated Period.
- Refund: Any portion of already-paid usage fees covering the period beyond 30 days after the departure date is refunded on a prorated basis.
- If the remaining paid coverage is 30 days or fewer from the departure date, the penalty consumes the entire paid coverage; no refund is issued and no additional charge is made for any shortfall.
- Cleaning fee is excluded from the mid-stay refund calculation (as the service has already been rendered).
- Refund calculations use the Guest's designated departure date as the reference, independent of actual usage or actual departure date.
- Refunds are processed to the Guest's original payment method; processing time may vary depending on the PG/card issuer.
4) Future Departure Date Requests
When requesting early termination, the Guest may designate the departure date as either today or a specific future date.
- Same-day designation: the penalty and refund under §3 are calculated and executed immediately.
- Future-date designation: (a) No funds move at the time of the request; the reservation remains active. (b) On the designated departure date, the refund is automatically executed under §3. (c) If the Guest submits another request before the designated date arrives, the last-submitted departure date and reason prevail. (d) Periods commencing after the designated departure date will not be newly charged; charging and collection for Periods commencing before the designated departure date continue to apply.
5) Relationship to Settlement
- Amounts refunded to the Guest under the provisions above are deducted from Host settlement pursuant to Article 7 §3.
- Where a refund is confirmed after settlement has already been paid out, the adjustment is made against the next settlement pursuant to Article 7 §7.
- Refunds arising from grounds under Article 5 (Fraudulent Listing & Guest Protection) are governed by Article 5 rather than by the calculations in this Article, and amounts refunded by the Company may be recovered from the Host by way of indemnification.
- Each Period is settled within six (6) business days from its Period settlement date. Settlement is processed manually by the Company's administrator.
- Period settlement date: the move-in date for the first Period, then every 30 days after that. This date is fixed regardless of when the Guest actually pays.
- Host Service Fee. The Company may charge a service fee to the Host as consideration for the Service, deducted at the time of settlement. (a) Rate. The rate is determined by the Company within a range of 0% to 10% of the sum of rent and maintenance fee for each Period. The actual rate applied may vary within this range depending on promotions, individual contracts, discount policies, events, host tier, and similar factors. (b) The rate displayed in the Host settlement disclosure at the time of reservation confirmation is the final rate applied to that reservation. Subsequent rate changes do not affect the settlement of already-confirmed reservations. (c) The Host service fee for each Period is calculated as (rent + maintenance fee) × the confirmed rate. The cleaning fee is excluded from the rate calculation base.
- The Company may deduct only:
- The Host Service Fee (paragraph 2)
- Refund amounts (per policy or dispute adjustment)
- Dispute adjustments
- Confirmed damages
- PG fees shall not be deducted.
- Unpaid utilities shall not be deducted.
- Settlement may be withheld reasonably during disputes.
- Previously paid amounts may be adjusted in future settlements if justified.
The Company may suspend or terminate accounts for:
- Fraudulent listings
- Repeated disputes
- Legal violations
- Platform trust violations
Membership withdrawal & account recovery (30-day grace period): Hosts may request withdrawal at any time within the Service. Upon the request, the account is suspended immediately and registered listings are unpublished. To support account recovery and prevent misuse (e.g., re-registration by malicious users), member information is retained for 30 days after the withdrawal request and then completely destroyed without delay. Logging in again within 30 days restores the account and its listings. During the grace period the account cannot be used and the same email address cannot be used to sign up again. Reservation requests automatically cancelled at withdrawal are not revived upon recovery. All marketing communications stop immediately upon the withdrawal request. Withdrawal may be restricted while an active contract or pending settlement remains. Statutory record retention follows the Privacy Policy.
Hosts indemnify the Company against losses arising from Host misconduct or legal violations.
These Terms are governed by Korean law.
The Company may notify Hosts by posting on the Service or by email (help@homesinkor.com); Hosts must keep their contact information up to date. When these Terms are amended, the Company announces the effective date and the reasons at least 7 days in advance, and at least 30 days in advance for changes unfavorable to Hosts.
